Test phase. smileeasy is in a test phase. No real money is taken: the payment page is Stripe's test environment, and no card is charged. The clinics listed are example clinics that we created to show how smileeasy works, and a booking at one does not lead to an appointment. We will remove the example clinics, and this notice, before real bookings start.
These terms apply when you use smileeasy.ch as a patient or visitor: when you create an account, message a clinic, book an appointment, pay a reservation fee or write a review. Please read them together with our privacy policy, which explains how we handle your data.
These terms are published in English, German, French, Italian, Greek and Polish. The English text is the original. If a translation is unclear or differs from it, the English text applies. This does not take away any protection the law of your country gives you as a consumer.
1. Who we are
smileeasy, Heinrichstrasse 267A, 8005 Zürich, Switzerland. Email: contact@smileeasy.ch. Phone: +41 78 939 95 09.
The company that will operate smileeasy is being founded. Once it exists, we will name it here, with its legal form and register number, and it will take over these terms with every booking made under them. Until then, the team running smileeasy at the address above is your contracting partner.
"We" and "smileeasy" mean that operator. "You" means you as a user of smileeasy. A "clinic" is a dental clinic listed on smileeasy.
2. What smileeasy is, and what it is not
- smileeasy is a marketplace. We show dental clinics in several European countries, help you compare them, let you message them, and let you reserve an appointment by paying a reservation fee.
- smileeasy is not a dental or medical provider. We do not examine, diagnose, advise on or carry out treatment, and nothing on smileeasy is medical advice. The magazine and other articles are general information; they do not replace a consultation with a dentist.
- Your treatment is a matter between you and the clinic. The clinic decides, after seeing you, which treatment is appropriate. The treatment contract, its price, payment, guarantees, aftercare and any change or cancellation of the treatment are agreed between you and the clinic under the clinic's own terms and the law that applies to it.
- Prices on smileeasy are estimates. The treatment prices shown are the clinic's estimates for a treatment scope. The actual price is set by the clinic after your consultation. Savings compared with Swiss prices are indicative, calculated from a Swiss reference price.
- Clinic information comes from the clinic. We check every clinic profile before it is published, but the clinic is responsible for its content: its team, qualifications, licences, photos, prices, opening hours and languages.
3. Your account
- You must be 18 or older to create an account, and you confirm this when you sign up.
- Give correct information and keep it up to date. Your account is for you alone; keep your password secret and tell us at once if someone else may have used it.
- You can only book for yourself. Booking for another person is not possible.
- You can delete your account at any time on your account page. While you have an upcoming paid appointment, cancel it first (or let it take place); the account page explains this.
4. Messages to clinics
You can message a clinic from its page, before and after booking. The clinic receives your name, your profile picture (if you have one) and your messages as soon as you send them, and the clinic answers in its own name. Please use the chat only for questions about your possible treatment and visit; no advertising, no insults, no content you do not have the right to share. For health details, use the medical questionnaire after booking instead of the chat. We may remove messages that break these terms.
5. Booking and the reservation fee
How a booking works.
- You choose a clinic, a treatment, a treatment scope and a free time slot, and you give your booking consent (our privacy policy explains it).
- We hold the time slot for you and open a payment page. If you do not complete payment within 30 minutes, the booking lapses and the slot is released. Nothing is charged.
- When the reservation fee is paid, the booking is confirmed. We confirm it by email and pass your booking and contact details to the clinic.
- You can then fill in the clinic's medical questionnaire and send the clinic a note. Both are optional.
You can hold at most a few unpaid bookings at the same time, and some clinics or countries may not be bookable. Clinics in France are listed but cannot be booked at present.
The reservation fee.
- The reservation fee is a fixed amount in CHF per treatment, shown before you pay. We charge it in our own name, through Stripe.
- It reserves your appointment with the clinic. The clinic deducts it from the cost of your treatment when you agree a treatment with the clinic.
- It is not a payment for treatment. You pay the treatment itself directly to the clinic, under the clinic's terms.
Changes by the clinic. A clinic may propose to move your appointment. You can accept or decline the proposal on your booking page. If a change the clinic asked for does not suit you, contact us: a cancellation that follows from a change the clinic asked for is treated as a cancellation by the clinic, with a full refund.
6. Cancellation and refunds
| Who cancels, and when | What happens to the reservation fee |
|---|---|
| You, more than 48 hours before the appointment starts | Refunded in full. |
| You, within 48 hours before the appointment starts | Not refunded: you lose the reservation fee. There is no other charge on top of it. |
| You do not attend without cancelling | Not refunded, as for a cancellation within 48 hours. |
| The clinic cancels, at any time | Refunded in full. |
| smileeasy cancels, at any time | Refunded in full. |
- You cancel on your booking page, until the appointment starts. After the start, contact us.
- Refunds go back to the card you paid with, through Stripe. Your bank may take several business days to show it.
- The treatment itself is between you and the clinic. Its cost, rescheduling or cancelling a treatment you agreed with the clinic, deposits the clinic asks for, and any fees for that are governed by the clinic's own terms.
- Once the appointment has taken place, the reservation fee is not refunded; it is deducted from the treatment you agree with the clinic.
- If the law of your country gives you a right of withdrawal or other mandatory rights as a consumer, these terms do not limit them.
7. Reviews
Who can review. After an appointment, we send you a personal link to review the clinic. Only patients with a booking at the clinic can review it, and only once per booking. Reviews are published under your first name and the first letter of your surname, with your consent. We do not pay for reviews and we do not let clinics pay for them, choose them or edit them.
What a review may contain. Your own, honest experience of the clinic. A review must not contain:
- health information about another person, or personal details of anyone (staff may be named by name only);
- insults, threats, discrimination or content that is unlawful;
- statements of fact you know to be false;
- advertising, links or content unrelated to the clinic;
- content you do not have the right to publish.
How reviews are shown. Reviews appear on the clinic's page with their rating. We publish positive and negative reviews alike. We do not change the text of a review.
Taking a review down.
- You can ask us at any time to remove your review. We take it down at once and delete it within one month.
- We may take a review down if it breaks these rules, or if we receive a notice that it is unlawful and we find the notice justified. We tell you by email which rule or law the decision rests on and why, and you can reply to contest it; we then look at the decision again, with a different person where possible. A review we took down is deleted 6 months after the takedown.
- We never take a review down only because it is negative or because the clinic asks.
8. Reporting unlawful content (notice and action)
Anyone can report content on smileeasy that they believe is unlawful or breaks these terms: a review, a clinic profile, an article or a message. Write to contact@smileeasy.ch with:
- the web address of the content, or enough detail to find it;
- why you believe it is unlawful or breaks these terms;
- your name and email address (unless the report concerns certain sexual-abuse offences, where you may stay anonymous);
- a statement that you believe in good faith that your report is accurate and complete.
We confirm receipt, examine the report diligently and objectively, and tell you our decision. If we restrict the content, we tell the person who posted it which rule or law the decision rests on, and they can contest it as described in section 7. We may suspend accounts that repeatedly post clearly unlawful content or send clearly unfounded reports, after a warning.
Authorities can reach us at contact@smileeasy.ch in English or German.
9. Using smileeasy fairly
Do not misuse smileeasy: no fake accounts or bookings, no attempts to reach other people's data, no automated scraping, no interference with the website's security or operation, and no use of clinic contact details for advertising. We may suspend or close an account that seriously or repeatedly breaks these terms. We tell you why and you can contest it; for anything less than a serious breach, we warn you first.
All content on smileeasy (texts, photos, design, articles) is protected. You may view and share it for personal use, but not copy it for commercial purposes.
10. Availability
We work to keep smileeasy available and correct, but we cannot guarantee that it will always be available or free of errors. We may change, extend or reduce our service. We will not remove a confirmed booking because of such a change; if we cannot honour it, we cancel it with a full refund.
11. Liability
- We are liable for damage we cause intentionally or through gross negligence, and for injury to life, body or health that we cause, without limit.
- For slight negligence, we are liable only to the extent the law does not allow us to exclude it, and only for foreseeable, typical damage.
- We are not liable for the clinics. The clinics are independent businesses. We are not liable for their treatment, advice, prices, cancellations of treatment or anything else they do or fail to do; claims about treatment are made against the clinic.
- We are not liable for the content of external sites we link to, or for interruptions caused by events outside our control.
- Nothing in these terms limits liability that cannot be limited by law, including mandatory consumer protection law of the country where you live.
12. Changes to these terms
We may change these terms when our service or the law changes. We tell you about changes by email or when you next sign in, at least 30 days before they take effect. If you do not agree, you can delete your account before then. Changes never apply to a booking already confirmed.
13. Law and courts
These terms are governed by Swiss law. If you are a consumer living in another country, you also keep the protection of the mandatory consumer law of that country.
If you are a consumer, you can bring proceedings against us in the courts of your place of residence or of our seat in Zurich, Switzerland, and we can bring proceedings against you only in the courts of your place of residence.
We would like to solve any problem with you directly first: write to contact@smileeasy.ch.
